    Administrative Law

    The field of administrative law is one of the more important ones in the firm. In this field, we provide services to business entities and some of the largest organizations operating in Israel. The services we provide are comprehensive and include an array of legal matters where governmental entities and functions are involved, including representation in legislative processes before parliamentary (Knesset) committees, representation before various regulatory bodies, representation before government ministries, representation of local authorities and municipalities, planning bodies and licensing processes before local government.

    Over the years we amassed great success cases under our ‘belt’ and in doing so, have developed a unique style that facilitates the accomplishment of unique and impressive achievements for our clients, whether before court instances or in out of court agreements. A wide array of leading market players come to us as a result of our vast experience and in-depth understanding of the ins-and-outs of administrative bodies and their operational process.

    We view administrative litigation, and specifically, petitions to the High Court of Justice, as a tool to initiate discussions, and do not shy away from instigating legal proceedings as a manner of forcing governmental and regulatory bodies to adopt speedy decisions on complex matters.

    We have accomplished exceptional achievements in our representation of clients before the High Court of Justice, administrative tribunals and courts, in proceedings before Courts of Local Affairs, various regulators, appellate committees and more.

    Additional noticeable fields of practice we handle falling under the auspices of administrative law include: environmental law, public tenders, planning and zoning, local authorities, municipal taxation, business licensing, expropriations, municipal border disputes and more.

    We are often involved in cases that raise complex and precedential constitutional questions, the outcome of which stretch far beyond the closed confines of the individual case, and more often than not, will have far-reaching implications on the entire Israeli business sector. In these cases we work cohesively with the other departments in our firm to form a substantial and formidable legal force for our clients.

    Our administrative law experts partake in the drafting of legislative bill proposals that deal with public tenders.

    Over the years we represented in numerous petitions, some of which are described below:

    • Representation of a client against a local municipality following the termination of the contract with our client by the local municipality. The contract had been entered into by virtue of a public tender won by our client, a company operating in the planning, marketing and building of hundreds of residential units and hundreds of thousands of square meters of employment and commerce structures in the South Bat Yam Business District. The contract was valued at billions of NIS, and involved a complex legal matter from the realms of planning and zoning laws, property laws, public tender laws and unjust enrichment equitable laws.
    • Representation against a local municipality for expropriation of a plot belonging to the Druze Wakf.
    • Representation of a group of 120 residents in a leading city in Israel, in their efforts to prevent the destruction of the city’s largest and unique green area that hosts a thriving and active community garden.
    • Filing an administrative petition against the Israel Land Authority for a reassessment of value.
    • Abrogation of demolition orders.
    • A petition against the Supervisor of Banks for supervisory failures; and many more.
